Testaments and Testamenters

Some years back while in Local Studies section of Aberdeen City Public Library I came across the following book; The Commissariat Record of Aberdeen, Register of Testaments 1715-1800, Edited by John McLeod, The Scottish Record Society 1899.

The Register of Testaments and most other Commissiary records for Aberdeen were lost in a fire in 1722. The book made mention of the following original testament documents held in Edinburgh at The Scottish Records Office. My father sent away for the two that were evidently Corryhoul McHardys. I have done my best to write out the contents of these below. You can check out the glossary web page for any unknown words you find.

Edward in Corriehoul

These original three documents are Copyright the Scottish Records Office Reference CC1/6/11 Edward McHardie 18/06/1730.

From these documents we know that there was an Edward McKardy in Corriehoul in 1713 and that he died in August 1714 owed money. A John Mackhardy of Dellachash was decreed Exer Dative to the said Edward. Dellachaish (modern day spelling) lies just across the River Don from Corriehoul, the ruin still stands. I would therefore assume John to be some form of close relative, probably a son, brother, or cousin. There is a gravestone making mention of Dellachaish McHardy's in Strathdon cemetery.

Master Robert Paterson Commissary of Aberdeen to ?

Exers hereof ? and Sea the Spea ? llie ?. Constitute, We charge you ? those present.

Soon ye past to the most patent Kirk door of the parioch Kirk of Strathdon. And ther call upon an Sunday beforenoon, Immdeiately after Divine Services, in presence of the pariochiners convened for the time Lawfully Summons, Warn and Charge. The ? and nearest in kin of Edward Mckardy in Corriehoull now deceased.

And all and Sundry others having or pretending to have interest, To Compear before us or our Deputes in a court to be holden within the Casisterie? place of Aberdeen upon the Eighteenth Day of June 1730. To hear and see Exers Testamentae, (if there any be, and failing thereof Delivers lawfully given and Confirmed In and to the goods gear and debts which pertained and belonged to the said Defunct, with certification. If they do not compear We will Deem the pror? Fiscall Exer Dative to the said Defunct, Or then to ??????? Given at Aberdeen the second day of June 1730.

Second Document re Edward McHardie

Upon the ? day in June 1730 (The said day being Sunday) I James McFarlane officer by virtue of the mission? written Edict, Past to the most patent door of the parroch Kirk of Strathdon, and Theral upon an Sunday beforenoon immediately after Devine Service, in presence of the parrochiners conveened for the time, by open proclamation and publick reading of the Said Edict, Lawfully Summoned Warned and Charged the hail persons within named and designed, and all and Sundry others having or pretending to have interest, to Compear time place and to the effect within mentioned And made certification in manner within exprest. And that non might pretend Ignorance I affixed and left within the most patent Door of the said parroch Kirk of Strathdon and post an authenteek Copy of said Edict. Subserved with my hand before witnesses.

Third Document re Edward McHardie

Inventory of the goods gear and debts which pertained and were Resting owing to the deceast Edward McKardy in Corriehoul the time of his decease. Who deceast in the month of August 1714, given up by John McKardy in Dellachash Exer Dative concerned to the said Defunct, before the Commissary of Aberdeen. Conform to a decreet of Exerie pronounced there anent of the date of those present, By virtue of his oath, and under Protestation That he have liberty to eik to the inventory underwritten As afterwards comes to his knowledge. That he be no further liable sed secundum viries Inventory, And that he have Allowance and k? in his own hands, Out of the first end of the sums of money underwritten of the Defuncts funerall expences And all other preferable and priveledged Debts, and of the expences of the present Confirmation, And Generally of all other Charges and Expences. The said Exer. has debursed, or may deburse and be putt to. In reference to, And in going about the said office of Exerie, any manner of ways.

Imprimis The said Exer. (With and under Protestations always above written) Gives up grants and confesses, That there pertained, and were resting owing to the said Defunct, the time of his decease forsaid. The particular goods gear and debts underwritten, Viz the sum of One hundred merks Scots of principall with the ? aserts? thereof since Martinmass 1713, With a fifth part of the said principall Sum by reason of failzie. Contained in a bond Granted by John Forbes of Inverearnen Deceast To the said Deceast Edward McKardy of the date the seventeenth day of February 1713.

At Aberdeen The Eighteenth day of June 1730. In presence of Mr Robert Paterson Commissiary of Aberdeen. The which to Day the Commisar forsaid Confirms the said John Mckardy Exer Dative to the said Edward Mckardy Conforms to the forsaid decree(?) of Exerie, Has taken his oath on the forsaid Inventory. And received John Farquharson in Ordgarf Cautioner for him, that the sum of money Contained in the above inventory shall be forthcoming to all Persons and Partise having interest therein as accords the law.

Marjory, Late in Burnside of Corriehoul

These original three documents are Copyright the Scottish Records Office Reference EX CC1/6/45 Marjory McHardy 15.7.1772.

From this testament we see that Marjory McHardy had a sister german called Jean McHardy living in Cockbridge, and that she probably had a son called Alexander McHardy. Somebody certainly felt the need to have him back-up as Cautioner to the Executric Jean by having Forbes of Inverernan stand subsidiary liable.

First Document re Marjory McHardy

Alexr Innes of Breda Esquire Commissiary of Aberdeen to (space) exerts here one or more ? ? Specially Constitute Greeting . We charge you herefore that in (?) this our precept? sees yes? to the most patent gate or door of the Parish Kirk of Strathdon and there early upon a Sunday before noon immediately after devine service at disolving the congregation and in the presence of the Parishoners concerned for the time lawfully summons warn and charge the hail nearest in kin of the Deceased Marjory McHardy late in Burnside of Corryhoul.

And all and sundry others having or pretending to have interest to compear before us or our Deputes in a Court to be holden by us within the Laigh? Toolbooth of Aberdeen upon the Twenty-fifth day of June next (??). There to hear and (?) Executas Testamenas if any be/ and failing them Datives lawfully given and confirmed in and to all the Sundry Goods Gear Depts and Sums of Money which pertained and belonged to the said Deceased Marjory McHardy the time of her Decease withe certification if they compear (?) we will decern Jean McHardy in Cockbridge Sister German to the said Defunct Executrix and nearest in kin to her________________.

Or then to allege (?) which to do etc (?) Given by Aberdeen the fourteenth day of march 1771.

Edict of Executry of Marjory McHardy Decreet 1771.

4 July 1771

Upon the fourteenth day of April 1771 years I Alex Stuart officer and Exer. hereof by virtue of the within Edict pass(?) command thereof to the most patent gate or door of Parish Kirk of Strathdon and thereat/ the said day being Sunday/ in the forenoon immediately after Devine service in presence of the Parishoners conveened for the time lawfully Summond warned and charged the hale persons within named and designed and all and sundry others having or pretending to have interest in written Edict to compear day place and to the effects within mentioned and to the end none might pretend ignorance. I affix and left upon the said kirk door a full double of the (?) edict this I did before and in the presence of Duncan Stuart in Aldahue and John Mcrobie in Drumanety witnesses present at the premises and hereto one subserving.

Third Document re Marjory McHardy

At Aberdeen the fourteenth day of July 1772 years in presence of Alex Innes of Breda Esq, Commissiary of Aberdeen.

The Commissiary forsaid confirms the said Jean Mchardy in Cockbridge Exerix. Dativ qua nearest in kin to the said Defunct her sister Germain, conforms to the Direct? of Executry before mentioned and Grants full power and warrant of Intromission to the said Executrine with sums contained in the forgoing Inventory and Receives Alexander Mchardy in Cockbridge as cautioner for the said Executrix that the sums of money above written shall be made forthcoming to all parties having interest therein as accordsof the law, and the said Executrix obliges herself to free and releive her said Cautioner hereby submit themselves to the said Commissiary's Jurisdiction in all matters relating to the said Executry and affix the Commissiary Clerks office of Aberdeen as the Domicile for laying on all citations against him or either of him who shall hereafter happen to live without the said Commissary's Jurisdiction.
