Glossary of Terms and Bibliography

In preparing this website project I came accross a number of terms I was unfamiliar with. I have written these below with a simple explanation in the hope they are of some help in making sense of some of the pages. I have also listed the sources of the books used in the creation of this website so you can locate them for your own use.

Glossary

Bailey (Bailze) - the upper or lower court of a castle.

Disponed - Legal term, made over or conveyed to another.

Executer - someone appointed to administer the moveable (non-hereditery) property of the deceased. Usually appointed in a will (executer nominate) though this appointment must be confirmed by the relevany court. If the deceased has died intestate then the executer (ececuter dative) will be appointed and confirmed by the court.

Failzie - failure, non performance of an obligation.

Freeholder - before 1832 only a tiny minority of Scots men (and no women) elected representatives to Parliament. Representatives of the counties were elected by freeholders, who were men who owned land or other heritable property in that county above a certain value.

German - (used in combination) having the same parents as oneself eg. brother german; or having a parent that is a brother or sister of either eg. cousin german.

March - a boundary.

Oxgang - as much land as could be tilled by the use of an ox.

Portioner - one who possesses part of a property which had been originally divided among co-heirs. The proprieter of a small estate or piece of land once part of a larger estate.

Sasine - the act or procedure of giving possession of fuedal property.

Sasine, Instrument of - the deed or document recording the transfer of property.

Shieling - a high or remote summer pasture where temporary homes are built.

Tack - a tenancy was usually constituted by a document known as a tack (a lease).

Tacksman - a chief tenant who leased the land directly from the landowner and sublet it to lesser tenants.

Testament - the records of the confirmation of executers are testaments. If there is a will they are known as testament-testamentar, and if there is no will testament-dative.

Terce - the right of a widow to life-rent of one third of her husband's heritable estate, if no other provision has been made for her.

Vassal - a person who holds heritable property in feu from a superior.

Wadset - a contract under which the lender got actual possession of certain lands, and continued to occupy them, virtually as proprietor, until the money was repaid, sometimes after generations had passed.
