and the owner and operator of PDRhealth, may revise and update these
Terms and Conditions at any time. Your continued usage of the PDRhealth
site ("PDRhealth Site," or the "Site") will
mean you accept those changes.
LICENSE
TH grants, and you hereby accept, a nonexclusive, nontransferable,
revocable license to use the software, content, and documentation
contained in PDRhealth on the terms and conditions set forth in
this agreement.
THE SITE DOES NOT PROVIDE MEDICAL ADVICE
The contents of the PDRhealth Site, such as text, graphics, images,
information obtained from TH's licensors, and other material contained
on the PDRhealth Site ("Content") are for informational
purposes only. The Content is not intended to be a substitute for
professional medical advice, diagnosis, or treatment. Always seek
the advice of your physician or other qualified health provider
with any questions you may have regarding a medical condition.

Information received through PDRhealth is to be used solely for
individual purposes. None of the content of PDRhealth may be reproduced,
transcribed, stored in a retrieval system, translated into any language
or computer language, retransmitted in any form or by any means
(electronic, mechanical, photocopied, recorded, or otherwise), resold,
or redistributed without the prior written consent of TH, except
that you may view or download a single copy of the material on the
TH Site solely for your personal, noncommercial use if you include
the following copyright notice: "Copyright (c) 1996-2005, Thomson
Healthcare Inc. All rights reserved" and other copyright and
proprietary rights notices that are contained in the Content.
For information obtained from third-party licensors you are solely
responsible for compliance with any copyright restrictions and are
referred to the publication data appearing in bibliographic citations

Title to the Content remains with TH or its licensors. Any use of

MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT
TO PDRhealth, OR THE USE THEREOF. NEITHER TH NOR ITS LICENSORS SHALL
BE LIABLE UNDER ANY CLAIM, DEMAND, OR ACTION ARISING OUT OF, OR
RELATING TO, THE USER'S USE OF PDRhealth, NOR THE PERFORMANCE OF
TH OR THE LACK THEREOF UNDER THIS AGREEMENT FOR DIRECT, SPECIAL,
INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION,
LOSS OF PROFITS OR OTHER DAMAGES CAUSED BY THE INABILITY TO USE
PDRhealth, WHETHER OR NOT TH OR ITS LICENSORS HAVE BEEN ADVISED
OF THE POSSIBILITY OF SUCH CLAIM, DEMAND, OR ACTION. NEITHER TH
NOR ITS LICENSORS MAKES ANY WARRANTY THAT TH IS COMPATIBLE OR OPERABLE
WITH THE USER'S COMPUTER EQUIPMENT OR SOFTWARE, THAT TH WILL PERFORM
WITHOUT INTERRUPTION OR FREE OF ERRORS, OR THAT THE INFORMATION
CONTAINED THEREIN SATISFIES GOVERNMENT REGULATIONS REQUIRING DISCLOSURE
OF INFORMATION ON PRESCRIPTION DRUG PRODUCTS.
No salesperson or other representative of any party involved in
the distribution of PDRhealth is authorized to make any warranties
with respect to the service beyond those contained in this agreement.
Oral statements do not constitute warranties, shall not be relied
upon by you and are not a part of this agreement.
ADVERTISEMENTS, SEARCHES AND LINKS TO OTHER SITES
TH may provide links to third-party web sites. TH does not recommend
and does not endorse the content on any third-party web sites. TH
is not responsible for the content of linked third-party sites,
sites framed within the PDRhealth Site, third-party sites provided
as search results, or third-party advertisements, and does not make
any representations regarding their content or accuracy. Your use
of third-party web sites is at your own risk and subject to the
terms and conditions of use for such sites. TH does not endorse
any product advertised on the PDRhealth Site.
INDEMNITY
You agree to defend, indemnify, and hold TH, its officers, directors,
employees, agents, licensors, and suppliers, harmless from and against
any claims, actions or demands, liabilities and settlements including
without limitation, reasonable legal and accounting fees, resulting
from, or alleged to result from, your violation of these Terms and
Conditions.
PRIVACY POLICY
TH collects aggregate information on what pages are visited. We
do not collect user-specific page view data of any sort. The information
we collect is used for internal review, to improve the content and
functionality of our web site. We also collect information volunteered
by visitors to our sites, such as survey responses and e-mail list
registrations.
For users who have granted us permission by asking to receive e-mail
from PDRhealth by specifically opting in to our mailing list, we
use the information we collect for marketing purposes and to provide
promotional information about new products and special offers from
TH and its affiliates. We do not use this information in any way
that identifies registered users individually to any third party
without the user’s prior consent, but may share this information
in aggregated form. We do not collect the e-mail addresses of
users who do not specifically opt-in to the PDRhealth e-mail list.
Users who no longer wish to receive promotional messages from TH
can change their e-mail preference by e-mailing us at PDR.PDRhealth@thomson.com
with their first name, last name, and e-mail address, and request
to be removed from the PDRhealth mailing list.
GENERAL
If any provision of this agreement is determined to be invalid under
any statute or rule of law, the same shall be deemed omitted and
the remaining provisions shall continue in full force and effect.
This agreement shall be deemed to be made in the State of New Jersey
and shall in all respects be interpreted, construed, and governed
by and in accordance with the laws of the State of New Jersey applicable
to contracts executed and to be wholly performed therein.
This agreement constitutes the entire agreement between the parties
with respect to the subject matter hereof and supersedes all prior
agreements, oral or written, and all other communications relating
to the subject matter hereof. No amendment or modification of any
provision of this agreement will be effective unless set forth in
a document that purports to amend this agreement and both parties
accept that hereto.
This agreement is personal to you and you may not assign your rights
or obligations to anyone.
