New Duke Nukem in development

At "well-known game developer", Take-Two lawsuit reveals
Duke Nukem Forever may be dead and buried, but a second Duke Nukem-based game is currently under construction at a "well-known game developer", the ongoing 3D Realms-Take-Two lawsuit has revealed.

Responding to the lawsuit filled against it by its former publisher, Duke dev 3D Realms (legal name Apogee) told the U.S. District Court in Manhattan the following (via GamePolitics):

"As part of the October 2007 Agreement, Take-Two agreed to pay Apogee $2,500,000 as an advance to help fund the development of the DNF game, but only after Take-Two visited Apogee to review the status of the development of the DNF game within Apogee.

"Repayment of the $2,500,000 advance was to come from royalties generated by sales of the DNF game and/or a new Duke Nukem-based game being developed in parallel by a separate well-known game developer under contract with Take-Two.

"The October 2007 agreement did not provide for a completion deadline for DNF. However, the development agreement for the new Duke Nukem-based game (not to be confused with the DNF game) being developed by the separate game developer scheduled the new Duke Nukem-based game to be completed by mid-2010.

"In the event the DNF game was not commercially released before October 22, 2012, then and only then, the $2,500,000 advance became due and payable to Take-Two, but only to the extent this advance had not already been recouped from royalties from sales of the new Duke Nukem-based game."

The revelations just keep coming. It's been noted that the second game the suit refers to is unlikely to be PSP compilation Duke Nukem Trilogy, as that's in development between Apogee and publisher Deep Silver - nothing to do with Take-Two as far as we know.

Who's the "well-known developer" working on this new Duke then? Gearbox? 2K Irrational? Guess away below.

Isn't that basically saying Take Two can't sue 3D Realms and they can finish DNF 'cos they don't have to pay back until 22nd October 2012?

exactly. i don't think a Duke Nukem game would fit in todays selection of games, except maybe alongside Eat Lead. a novelty game. MP might be a blast but the main game would probably be cringeworthy by todays standards.

Duke Nukem has never been about being clever or exploring unique game features. It's about machismo and sarcasm with a generous helping of explosions and boobs. There's ALWAYS a place for that in society :)

It'd be interesting to do something outside the box with it, although I can't think of anything outside the FPS genre that would work.

If the quoted excerpt is taken verbatim from a legally binding agreement, then it is essentially stating that 3D Realms (aka. Apogee,) were loaned 2.5 million which they would only have to pay back by 2012 to Take-Two (the lender,) if the DNF game has not been commercially released by that time. However - and this is the coup d'etat for 3D Realms/Apogee - if the other Duke Nukem title apparently being worked on by another company for Take-Two is released, *any* profits made from that game will go towards paying off the 2.5 million loan on behalf of 3D Realms/Apogee even though that other game is developed by a *separate* developer.

In essence 3D Realms/Apogee would receive royalties/licensing fees from the other developer which would automatically go towards their debt to Take-Two even though they (presumably,) didn't lift a finger to help develop that other new game. That's a hell of a deal, especially when taken in conjunction with the fact that repayment is only viable if DNF isn't commercially released by Oct. 22nd, 2012; unless specified elsewhere it doesn't stipulate in what sort of condition DNF needs to be in to be released in 2012 nor what sort of sales figures need to be achieved....

To each their own on this occasion. Personally I'd be willing to fork over good cash for a new Duke Nukem game even if it received a lukewarm reception. Granted, if it was a complete mess I'd be less than pleased afterwards, but Duke is an iconic figure and captures the true spirit of semi-mindless, gut busting, boot stomping, politically incorrect commentary, 100% red blooded male MACHISMO! It's a gift, I tell ya! :D

After seeing some of the stuff from the last build of Duke Nukem forever, it's all the more heartbreaking that it'll never come out. It really did look like they were making a truely brilliant game and something that would kick all these grey souless military fpss into touch.

**** fighting the same space marines and soldiers. I want space aliens and strippers!
