T2 fights for Duke Nukem Xbox 360

Publisher "entitled" to develop 360 port with source code
Get the popcorn; more dramatic details on Take-Two's lawsuit against Duke Nukem Forever developer 3D Realms have emerged, and plenty of new allegations made.

In case you missed it (you numpty), the Duke Nukem Forever team was let go last month, with 3D Realms blaming funding issues for the collapse of the 12-year-old project.

According to court documents unearthed today, part of Duke Nukem Forever's downward spiral involved publisher Take-Two's negotiations to develop an Xbox 360 version of the game.

"Rather than develop the Xbox 360' version itself or hire another developer to do so, Take-Two solicited Apogee about expanding Apogee's current development of the PC Version of DNF to include an Xbox 360 version," reads the complaint.

Apparently 3D Realms "demanded that Take-Two fully fund Apogee's reaching certain milestones" if it were to develop the Xbox 360 version of Duke... demands that obviously didn't work out.

With Duke development now halted and the team let go, Take-Two says that 3D Realms "breached its commitment" to deliver the Duke Nukem Forever source code, preventing the publisher from developing an Xbox 360 version of the game.

"Take-Two intended to exercise its exclusive option... to independently develop the game for the Xbox 360 in the event that the parties could not reach agreement," the complaint reads, suggesting that if it has its way we could still see Forever in the shops...

"In accordance with its rights... Take-Two is entitled to obtain from Apogee the source and object code for the PC Version in order to port the PC Version into a version for the Xbox 360," the complaint adds.

In light of its publishing rights, 3D Realms is prohibited from "publishing, releasing, exploiting, selling, transferring or destroying any proprietary information and assets related to DNF, including, without limitation, the source and object code for the game," Take-Two claims.

Take-Two's most shocking claim though, is that "upon information and belief, [3D Realms] has title to a substantial amount of funds deposited in an off-shore account, which Take-Two believes Apogee can use to fund its outstanding obligations."

In a statement given to Shack News, 3D Realms founder Scott Miller said: "Do readers here realize that filed lawsuits are entirely one-sided statements, based on knee-deep BS and with more spin that a top?

"3DR has been in nearly a dozen lawsuits (including against Warner and Fox). We're always innocent, and we always win. This one is no exception. Give it a year, then the truth will come out."

I have been waiting for this from when it was first announced, DNF should stand for "Did Not Finish" I would not hold my breath for the 360 version.

I hope we never get to see a released DNF. There is no way it could ever live up to the expectations and it would be destined to fail.

What the Hell have the Devs being doing the last 12 years and who the Hell was paying them?

The team should have been sacked years ago.
Spending 12 years on one game, which let's be honest, wouldn't have blown the world away, is pure madness.
Would be nice if someone picked up the source code and finished it off, but can't really see it happening myself.

we still have the psp version wich is supose to be out this year.
but as for DNF i wish they would hurry up finish the law ******** so some one can go back and finish the game so we can play it.
and WTF hapend to the duke nukem movie?

Somebody just release the ****ing game already! Shit, i'd buy a PC AND a 360 copy if it meant it actually got to shelves!
