STAHL: If someone’s in custody, as in Abu Ghraib, and they are brutalized, by a law enforcement person — if you listen to the expression “cruel and unusual punishment,” doesn’t that apply?

SCALIA: No. To the contrary. You think — Has anybody ever referred to torture as punishment? I don’t think so.

STAHL: Well I think if you’re in custody, and you have a policeman who’s taken you into custody–

SCALIA: And you say he’s punishing you? What’s he punishing you for? … When he’s hurting you in order to get information from you, you wouldn’t say he’s punishing you. What is he punishing you for?

The McCain Game Plan

Call it an educated hunch.

I think we’re seeing the seeds of the broader national security narrative that will be front and center by November.

McCain will paint Obama as a Hamas sympathizing, Ahmadinejad-coddling neophyte, a narrative that will dovetail nicely with the feverswamp’s frenzied and unhinged portrayal of Obama as an America-hating, Muslimy Marxist.

Simultaneously the drums of the Bush war cabinet will pound us closer and closer to the brink with Iran. Call me conspiratorial, but I think the shift of David “New Jesus” Petraeus from Iraq commander to Centcom commander is part of a broader strategy to shift the focus off of Iraq and back onto the broader “Islamofacist” threat, which also includes Syria, that builder of North Korean reactors.

For McCain national security is the only game he’s got — and the goal will be to change the conversation so that we’re no longer talking about the economy, or even who is the best man to resolve the war in Iraq, but rather who has the mettle and the experience to stare down Iran’s “increasingly lethal and malign influence.”

Obama Stops the Clock

For all you Fox News junkies out there — you’re out there somewhere — Barack Obama will end his two-year boycott and sit down with Wallace this Sunday.

Wallace has kept an “Obama Watch” clock (ripped from Fox’s “24″ — nothing like a little cross-promotion) ticking since Obama last agreed to appear on the show. At last measure, it was 765 days, 13 hours, 54 min, 47 seconds.

We’ll see how Wallace fills his long-sought time.

Wright to Re-emerge at the National Press Club

The Chicago Sun-Times’ irascible, “don’t-put-me-on-mute” Lynn Sweet is reporting that Obama lightening rod Jeremiah Wright will address media at a divinity conference this Monday in Washington, DC.

Conventional wisdom would probably point toward a disaster in the making for the exasperated Obama, who’s (unsuccessfully) tried to kill this story for weeks now. But if Wright behaves himself — or at least stops short of a “God Damn America” diatribe — he could help shift the spotlight back to the actual candidate and, say, his health care plan. Heaven forbid the media distract itself with issues!

The Obama Goalpost

Campaign manager David Plouffe on a conference call just now said that he expects Hillary will have picked up a maximum net of 12 delegates last night.

He also pointed out that the campaign is now 134 pledged delegates away from having the majority pledged delegates, which he called “the most important marker in terms of evaluating the contest.”

Plouffe said the campaign would soon “commence a countdown” to that “very meaningful event” in the campaign when Obama wins the pledged delegate battle.

If Obama splits the delegates from here on out, he’ll nose up to that line on May 13 in West Virginia.
