Definitions


Summary of Conditions of Use:

  1. Copies of genealogical research data collected and prepared for the web by Rosemary Lockie may be used freely by individuals pursuing their own family history research.
  2. Copies may NOT be made for sale, either on microfiche, or on shareware (or similar) collections on CDROM, or for any other commercial purpose whatsoever. Copies may not be added to other online collections either for free, or commercial access without permission.
  3. Any references to, or quotations from this material should also give credit to any original author(s) and/or data source.
  4. Links to this information from other web pages are welcomed, but please DO NOT copy this information as a whole to your own web site, or submit it for inclusion into other online databases whether free, or commercial.
  5. Please ensure any published extracts include a statement of these Conditions in full; any electronic extract (posting to Mailing Lists, &c.) should include a reference to the URL (web page address) of the page you obtained the information.

Background

If these conditions seem to you to a little dictatorial, please bear with me whilst I explain why I feel they are necessary. Generally speaking, if you are a family history researcher like me, pursuing your own family history as a hobby, and you are NOT seeking to copy information I've collected to your own web site there is nothing to worry about - please use the information freely, and with my best wishes. This page is aimed mainly (but not only) at those who would attempt to make monetary gain from my (or other people's) endeavours, or to present material I've prepared (perhaps unwittingly) as their own.

Note: Under English Law, material doesn't need to have a copyright statement to be copyrighted, and English Law would apply in any infringements of these conditions. I, or my contributors, reserve copyright of all material I've prepared for the web. Specifically, even if a book is now out of print and / or out of copyright, it does not mean that a transcription of it is out of copyright. Ideally there will be a link to this page from significant amounts of source material I've prepared, but there may be some pages I haven't got round to updating yet. If there are, then the same conditions must be understood to apply to them too.

Some of the material which is to be found on Wishful Thinking, and on the GENUKI sites for Derbyshire, Gloucestershire and Herefordshire is held in database form by me, and software to which I own the copyright is used to extract the relevant data and generate the pages which you see on these sites. A United Kingdom Act of 1997 specifically covers the compiling and use of database material. The notice below is required to be displayed in order to give me protection under this Act:

Database Right: All databases used for these websites are covered by the 1997 Database Regulations. Rosemary Lockie (and others as stated on the relevant pages) are the makers of the databases used for these websites and the owner(s) of the database rights. First published in 1998.


General aims:

I derive a great deal of pleasure in making my transcripts of books, census or parish registers, memorial inscriptions, &c. available on the Web. If you also find them useful that's great, and it is my intention to share information I've collected with others, providing it's for personal use only (normally with respect to genealogy).

Specifically:

I've been working in this field since 1993, and it has become apparent over the years that some people assume that any "out of copyright" material which they find on the web is theirs to use however they like, and therefore it seems that any regular transcriber needs to spell out the conditions of use to place upon his or her material.

If you haven't yet transcribed material in bulk yourself, you may be unaware of how much work is involved. Even with Optical Character Recognition (OCR) techniques, the results need proof reading, and checking, and converting into a suitable form for placing on the World Wide Web. I have spent many, many hours transcribing genealogical research material, and whilst I make it freely accessible on the web, I believe I have a right proportionate to the work involved to set conditions on use (or misuse) of copies outside that medium.

Primarily, you are WELCOME to use it for your own family history research, or to LINK to it from your own website, but please don't copy it as a whole or in part to your own site. Specifically, it is NOT to be used to augment other online databases, profit-making or otherwise, as in for instance Interment.net Cemetery Transcription Library. I don't really expect anyone to do this, as there would be a lot of work involved, but alas, a lot of things have happened to my transcriptions I didn't expect, so I feel compelled to mention it just in case!

You may however place the data on a floppy disk or other medium, or print the data and GIVE it to others, or post extracts to a mailing list but in all these cases, please make sure you say where the information comes from. This may not seem important to you right now, as YOU know where you found it, and (by now) who I am, but some time ago, I came across a third party offering a lookup of material I'd transcribed on a Newsgroup, with the suggestion it had been transcribed by the person who sent it to her! It is of course great to discover it's being passed around like this, but as you might imagine, I really don't enjoy someone else getting the credit for what I've done! Be aware these kinds of misunderstandings are rife - the principle of Chinese Whispers Rules OK!

Indeed, if there is any profit (or kudos) to be made out of this, then it is only right that it should come to me. I am not asking for any form of payment; but the conditions which I place upon use are that noone else should be able to profit from it either, either financially, or otherwise. This would include such things as selling copies on a CDROM, on a floppy disk, on a microfiche, or making copies available on a commercial World Wide Web site; printing for sale in any form whatsoever, selling or promoting products or services, soliciting clients, or any other commercial purpose whatsoever, or using my data to populate your own web site . I'm sorry, but this prohibition does include distribution by non-profit making organisations such as Family History Societies without prior permission.

I have not introduced deliberate errors into my transcriptions - on the contrary, I have tried to be as accurate as possible; however I believe it's most unlikely that an independent transcription would interpret the original combination of spellings, spacing and punctuation exactly as I have done unless they have copied my work, so any copies claiming to come from other sources can be easily tested.

I repeat: It doesn't have to say copyright on it to be copyrighted.

To those of you who want to use this material simply for what it contains in the way of historical and genealogical information, please enjoy it with my best (and free) wishes.

Likewise, have no objections to use of small quotes of data from this site (for instance to answer queries on Mailing lists and Newsgroups), but please provide the URL of the page you are quoting from to ensure that your readers are aware that the data is not yours and that there is copyright involved. Thank you.

Finally, after years of experience transcribing, and hammering out conditions of use such as these, it has become depressingly clear that I can't cover everything which might be dreamed up. In particular, I can't forecast what other media for distribution might evolve in future - as for example was the case before CDROMs became popular. When they weren't mentioned specifically, certain parties assumed it was OK to make commercial copies of my work on CD, even whilst copying to floppy disk was prohibited. This would be in direct violation of the spirit of this document, if not the wording, so if any other means for distribution of my work occurs to you which isn't covered, please don't assume because I haven't mentioned it explicitly that it's acceptable to me. Usually it won't be.
