Melanie McGuire Murder Trial

Courttv.com's Harriet Ryan on the trial of the New Jersey nurse accused of dismembering her husband

March 23, 2007

Court TV Host: Courttv.com's Harriet Ryan is here.

Harriet Ryan: Hey, guys.

Court TV Host: She's covering the McGuire murder trial in New Jersey. Welcome, Harriet.

Harriet Ryan: It's great to be here.

Court TV Host: Thanks for joining us online today. Anything you want to say before we take questions?

Harriet Ryan: Just that I think this is a very interesting case and I'm curious to see what questions people have.

Court TV Host: Here's a question people have been discussing all day...

Question from Laddybugg: where were the kids during all this so-called murder?

Harriet Ryan: Excellent question! As you guys know, it's not something that has come up in testimony yet or in the opening statements. The McGuires lived in a three-story rental townhouse, and the bedrooms were upstairs. It's been described as a very nice place by one witness, but it was by no means huge. At the time of the murder, one of the sons was two and the other four, approximately. I'd say the four-year-old would be too old to witness a murder and keep it to himself, and both would seem to be very unlikely to sleep through three or four gunshots. I'm having trouble answering this because there are so many variables, and the state hasn't spelled out exactly what happened in the house. Here are some things to consider: - Was Bill McGuire shot in the house? - The material wrapped around one of the bullets in his chest -- is it, say, a piece of pillow? Indicating the use of a makeshift silencer? - If, as prosecutors, say McGuire had an accomplice -- her parents and her best friend have both been suggested as possible accomplices -- than maybe one of them was watching the kids? As far as the power saw dismemberment, it seems the prosecutor believes that happened over the weekend when the children were at their grandparents house.

Question from JJ: Did prosecutors interview the children?

Harriet Ryan: There has been no mention of that at all. Haven't seen it in court documents either.

Question from JJ: Where they are now?

Question from jolee: Whre are her children and why haven't we seen pictures of them?

Harriet Ryan: They are living with their father's sister in New Jersey. We haven't seen pictures of them because it's not relevant to the case and Judge DeVesa is very, very insistent that their privacy be protected. He even blocks out their names in documents released to the media -- even though they've been identified in press reports and by witnesses.

Question from eowyn: Ws it her gun used?

Question from eowyn: Do they have the murder weapon? Or are they just guessing?

Harriet Ryan: The murder weapon was a .38. The bullets were wad cutters (sorry if I am not spelling correctly) a type of flat-top bullet used in target practice. She bought a .38 two days before he was last seen alive. She also bought ammo. There were two types of bullets at the gun store that cost the amount she spent -- I think it was $9.95 for a box -- one of them was a box of wad cutters. They recovered two slugs from the victim's body. One was in pristine shape and could easily be compared to a gun. Her gun has never been recovered. In conversations with her friends taped by police, she indicates that she thought it was in a lock box in a storage container. But that it turned out not to be there. She's said to friends her husband might have taken it with him.

Question from jolee: Had the McGuires closed on the house yet?

Harriet Ryan: Yes. They closed April 28 -- about 5:30pm if I recall correctly. That's one of the last thing he is known to have done.

Question from eowyn: Is the only motive for the murder an affair?

Harriet Ryan: If you're the defense, you say there's no motive at all. Melanie says on one of the tapes with James Finn that there's no reason for her to have killed her husband since she'd been having an affair for 2.5 years and never found it necessary before. Also, she filed for divorce after he went missing and the defense says that is proof that she had no problem with getting a divorce and that a divorce is a lot easier than murder. However, her lover Brad Miller said something during testimony this week that prosecutors may seize on -- he said that Bill McGuire had told Melanie that if she ever divorced him she'd never see the kids again. So perhaps the prosecutors will say, there's your motive. She wanted out and she knew that a divorce would be long and messy.

Question from sume: Harriet - Where did Melanie find her husband's car prior to moving it?

Harriet Ryan: In a casino. That's her story.

Question from impcat: They supposedly have video images of Melanie moving Bill's car in Atlantic City, so do they also have video of Bill driving his car and parking it in that same parking lot in Atlantic City?

Harriet Ryan: The video image is Bill's car being parked at the motel where it was eventually found on April 30. April 30 meaning the day it was parked, not the day it was found. The driver's no visible. Not There's no video that I know of him parking the car anywhere else before that.

Question from eowyn: Do you think the state is leaving a lot to speculate about?

Harriet Ryan: They haven't said, here is exactly what happened inside Two Plaza Drive between April 28 and May 4th. AAG Prezioso did not spell out in her opening how she believes Melanie McGuire killed her husband or dismembered his body. But maybe they will in summation.

Question from Mark: Harriet, did they find any blood in McGuire's home?

Harriet Ryan: Are you a member of the defense team? Because that is their strongest argument for a not guilty. There was no blood ever found in the McGuire home despite multiple searches, despite using luminol, despite taking the drain apart. No blood never.

Question from vu: Has anyone considered the possibility of the dismemberment having taken place in the pine barrens on way to ac? Very dark long road. Then she leaves his car in ac she then returns home in second car, dumps body. Has anyone checked family EZ Pass or friends about same time she was driving?

Harriet Ryan: The Pine Barrens theory! Perhaps the Jersey Devil was the accomplice. Just kidding -- this is interesting, but we haven't heard this theory or anything about the murder/dismemberment occurring outside the house. We learned yesterday that the police pulled EZPass records for McGuire's mother and stepfather and we know they searched their house as well.

Question from di: If he took off, he could have taken the luggage with him and run into the guys he owed money and they did him in and packed him in his own cases

Harriet Ryan: Yep. That's the defense theory. Here's the prosecution answer: really? So this guy who is never detached from his two cell phones and Blackberry leaves his wife and children and doesn't reach out to anyone by cell or Blackberry? His usage nosedived from the night of April 28 and the three communications that were made from his devices -- a sick-day email and two calls less than a minute in duration -- could have been made by Melanie McGuire. At least that's what the prosecution is going to argue.

Court TV Host: Thanks, Harriet - any closing thoughts?

Harriet Ryan: Thanks for your questions.

Court TV Host: Thanks again - come back next week!

Harriet Ryan: Ok.
